Who we are and when these terms apply#
These terms of service (the "Terms") govern the use of the HodlProxy website, proxy networks, dashboard and API (together, the "Service"), provided by HodlProxy ("HodlProxy", "we"). By creating an account or using the Service you accept them, together with the Acceptable use policy, the Privacy policy and the Refund policy, which form part of these Terms.
The Documentation describes how the Service behaves, down to the parameter and the status code, and forms part of these Terms. Where the Documentation and these Terms conflict, these Terms prevail. The version and date of these Terms appear at the top of this page.
Your account#
- You must be at least 18 years old and legally able to enter into a contract. If you act for a company, you confirm that you are authorised to bind it.
- You provide an email address at which we can reach you and keep it current. Notices sent to that address are deemed received.
- One account per person or organisation, unless we agree otherwise in writing. Sub-users, API tokens and whitelisted addresses belong to your account and are your responsibility.
- You keep your password, gateway credentials and API tokens confidential and tell us promptly through a support ticket opened from your account if you believe they have been compromised. We may then rotate them.
- We may ask you to confirm control of your account email before acting on sensitive requests such as refunds, deletion or a change of payout address.
The Service#
The Service gives access to residential, ISP, datacenter and mobile proxy networks, a prepaid wallet, a dashboard and an API, as described on the product pages and in the Documentation at the time of your order. Residential and mobile exits are third-party devices whose owners have consented to share their connection; their availability varies, and we do not guarantee that a given address, city or provider is reachable at a given moment.
We may add, change or withdraw features and locations. Where a change materially reduces what you have already paid for, we give at least 14 days' notice by email and on the status page, and you may request a refund of the affected unused balance or of the remaining part of an affected term under the Refund policy.
The Service is provided for business and professional use. Consumers may use it; where mandatory consumer law grants you rights that these Terms do not, those rights apply.
Prepaid wallet and payment#
- The wallet is funded in the cryptocurrencies listed at checkout (currently BTC, ETH, USDT, USDC, LTC, XMR, SOL, TRX, DOGE), from $20. Top-ups above the thresholds displayed at checkout receive a bonus credit (currently +10% from $100, +25% from $250, +40% from $500, +50% from $1,000); bonus credit is spent like any balance and is never paid out. The balance is kept in US dollars and credited at the exchange rate observed when your transaction is detected on its network, once it has the number of confirmations shown at checkout.
- Network (miner or validator) fees are paid by you. Under-payments are credited at the value received; over-payments are credited in full.
- The balance is not a deposit, does not earn interest, cannot be transferred to another account and can only be used to buy the Service. It does not expire.
- Prices are stated in US dollars on the pricing page and in the Documentation, exclusive of any taxes that may apply to you. We may change prices with 14 days' notice; a change never applies to traffic or terms already paid for.
- Every purchase is deducted from the balance at the time of the order. There is no subscription. Automatic renewal of a dedicated order exists only if you switch it on for that order: it is off by default, draws only on your prepaid balance and never on a payment method, sends you a receipt each time and can be switched off at any moment from the order page. If the balance is insufficient, the order simply ends.
Traffic, dedicated addresses and renewals#
- Residential and mobile traffic is metered in both directions (request and response, headers and TLS records included). Connections that fail before reaching the destination are not billed. The per-GB rate is set by the size of each purchase and applies to every GB in it; traffic stays on your account until used.
- ISP addresses, datacenter addresses and mobile devices are rented for a fixed term (24 hours where offered, 30, 60 or 90 days) and are delivered within 24 hours of the order, failing which you may cancel the order for a full refund. They end at the close of the term unless you renew before it; released addresses cannot be recovered.
- Datacenter orders include 100 GB of traffic per address per month, pooled across the order. When the pool is exhausted, speed is reduced until the next monthly cycle or until traffic is added; nothing is charged on top.
- A dedicated address that stays unreachable for more than 24 hours is replaced for the remainder of the term at no charge. A replacement is a different address. Blocks, rate limits or challenges imposed by a specific destination are not a fault of the address.
- Rates, tiers, discounts and location zones are those published at the time of the order.
Acceptable use and your responsibilities#
You use the Service only in accordance with the Acceptable use policy. You are responsible for the lawfulness of your use in every country concerned, including compliance with the terms of the websites and services you access, with data protection law when you collect personal data, and with export control and sanctions rules that apply to you.
You indemnify us against claims, fines and reasonable costs arising from your breach of these Terms or of the law, except to the extent caused by our own fault. This clause does not apply to consumers where mandatory law forbids it.
Our commitments and their limits#
- We operate the Service with reasonable skill and care, monitor it continuously and publish the results on the status page, including incident notes.
- Planned maintenance that affects the Service is announced on the status page at least 48 hours ahead where possible.
- We do not guarantee a specific uptime percentage, the availability of a specific address, city, provider or carrier at a given moment, or that any destination will accept, tolerate or not challenge proxy traffic. The behaviour of third-party websites is outside our control.
- The Service is provided as described in the Documentation. To the extent permitted by law, we give no other warranty, express or implied.
Suspension and termination#
- You may close your account at any time from the dashboard or through a support ticket. Unused wallet balance is refunded under the Refund policy; running terms continue until their end unless you ask for them to be released.
- We may suspend all or part of the Service immediately if we reasonably believe that the Acceptable use policy is being breached, that your account is compromised, or that the law requires it. We tell you what we observed, unless the law or the protection of others prevents it, and you may respond through a support ticket.
- We may terminate your account for a serious or repeated breach. In that case the unused balance may be withheld to cover the costs and damages caused by the breach; any remainder is returned.
- We may terminate the Service for reasons other than breach with 30 days' notice, in which case the unused balance and the remaining part of running terms are refunded in full.
- On closure, your personal data is deleted on the schedule set out in the Privacy policy.
Liability#
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for fraud, wilful misconduct, gross negligence, death or personal injury, or rights that mandatory consumer law grants you.
Subject to the paragraph above, we are not liable for indirect or consequential loss, loss of profit, revenue, data or business opportunity, or for blocks, bans, challenges or account actions taken by third parties against you. Our total liability arising from or in connection with the Service in any twelve-month period is limited to the amounts you paid us in the three months preceding the event giving rise to the claim.
Intellectual property, privacy and general provisions#
- The HodlProxy name, logo, website, Documentation and software remain our property or that of our licensors. You may use the Documentation and API to integrate the Service into your own systems. You may not attempt to bypass metering, authentication or the limits described in the Documentation.
- Data you collect through the Service is yours. Personal data we process about you is handled as described in the Privacy policy.
- Suggestions you send us may be used without obligation. We do not claim any right over your business or its data.
- You may not assign these Terms without our consent; we may assign them to a successor that takes over the Service, with notice to you.
- If a clause is found invalid, the rest remains in force. A failure to enforce a clause is not a waiver. These Terms, with the documents they incorporate, are the entire agreement between us regarding the Service. The English version prevails over any translation.
Changes to these terms#
We may change these Terms. Material changes are announced by email and on this page at least 14 days before they take effect, with a new version number and date. If you do not accept a change, you may close your account before the effective date and the unused balance is refunded under the Refund policy. Continued use after the effective date is acceptance.
Governing law and disputes#
If you have a complaint, send it through a Billing ticket opened from your account with your account email and any reference; we aim to answer within 30 days and to settle amicably. These terms are governed by the law of the operator's country of registration, as stated in the operator identification block at the top of this document, and disputes that cannot be settled amicably are brought before the courts of that country, without prejudice to mandatory consumer protection rules of your country of residence.
